1.1 cswsport.org.uk ("the Site") is operated by Coventry Solihull & Warwickshire Sport Partnership Support Team ( "cswsport.org.uk", "we" and "us").
1.2 Use of the Site is on the terms and conditions below. If you do not agree to these conditions stop using the Site immediately. By using this Site you are indicating your acceptance to be bound by these terms and conditions.
1.3 Please print off and keep a copy of these terms. They are a legal agreement between you and us can only be modified with the express permission of a Business Development Manager at Coventry Solihull & Warwickshire Sport. They should be read in conjunction with the details provided on the Site about how the Site operates and the services which are available. 1.4 We reserve the right to change these terms and conditions from time to time without prior notice by changing them on the Site. Please therefore visit this page regularly because the terms and conditions, which it sets out, are binding on you.
2.1 Whilst we are committed to using all reasonable endeavours to ensure that information on the Site or any other information we provided you with is accurate we make no representation or warranty that such information is accurate and up to date or complete and accept no liability for any loss or damage caused by inaccurate information. This Site gives a large amount of information and there will inevitably be some errors in it.
2.2 If you find any inaccurate information on the Site please let us know and we will correct it, where we agree, as soon as we can.
2.3 You should independently verify any information on this Site with the relevant volunteer placement recruiters or advertiser before relying upon it.
2.4 Any views expressed by volunteer placement recruiters or advertisers in advertisements on the Site are not necessarily our views or anyone connected with us.
3.1 You may download information from the Site for your own personal non-commercial use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and that of the copyright owner. In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyright material.
4.1 cswsport.org.uk, Coventry Solihull & Warwickshire Sport logo and our other logos on this Site are owned by Coventry Solihull & Warwickshire Sport and may not be reproduced without our express permission or if otherwise permitted under these terms and conditions. Other organisations and company names referred to on this Site (such those of as volunteer placement recruiters and advertisers) may be trademarks of their respective owners as indicated.
5.1 We provide hyperlinks to other sites which are operated by other organisations (such as those volunteer placement recruiters and advertisers appearing on the Site). We are not responsible for external websites that link to this Site or which are linked from it. That we include these hyperlinks does not imply any endorsement of the material on such sites or any association with their operators.
5.2 We reserve the right at our discretion to prohibit any link from another Internet site or equivalent entity to materials or information on this Site. Without prejudice to that, any link to material or information on this Site must be neither misleading nor deceptive and must fairly indicate cswsport.org.uk as the destination of the link.
6.1 Our Site is controlled and operated by us from our offices in Coventry, England. We are a distributor (and not a publisher) of content supplied by third parties which appears on the Site. Where content published on the Site is supplied by third parties, you understand that we do not control or endorse their contents in any way. All content which is offered by third parties is published in good faith but we do not (to the extent permitted by applicable law) accept responsibility for the accuracy or otherwise of such content (whether published on or off-line) and the use of such content. You assume total responsibility and risk for your use of our Site and use of all information contained within it.
6.2 If you make an arrangement with anyone named or connected with the Site this is at your sole risk.
7.1 Whilst we are committed to providing you with an excellent service by making our Site available we cannot guarantee that our Site will operate continuously or without interruptions or be error free. You must not attempt to interfere with the proper working of our Site and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, our Site, router or any other internet connected device.
7.2 You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use our Site and is compatible with our Site. You also understand that we cannot and do not guarantee or warrant that any material available for downloading from our Site will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
8.1 The following applies to all advertisements, messages, e-mails, CVs, ideas, suggestions, concepts or other material submitted by you to us for the purposes described on the Site, for example during the registration or ordering process ("Content"):
8.1.1 you must own or have the right to submit Content for distribution on our Site and all Content must comply with all applicable laws (including without limitation advertising laws);
8.1.2 you must ensure that all Content submitted to us is complete, accurate and true and does not infringe the copyright, design, privacy, publicity, data protection, trade mark or any other rights of any third party, nor be obscene, abusive, threatening, libellous or defamatory of any person or be otherwise unlawful; and
8.1.3 we have the right to monitor Content and may edit, reject or remove Content and/or suspend our Services if we believe it does not comply with the above and, in particular, we reserve the right to block incoming e-mails and other Content if we believe that their content is or may be inappropriate or otherwise does not comply with the above.
8.2 You grant us a non-exclusive, irrevocable, royalty free, transferable, worldwide licence to make available on our Site all Content that you submit to us for that purpose. You have sole responsibility for the Content which you submit to us and you shall indemnify and shall keep us fully and effectively indemnified on demand from and against all losses and liabilities (including legal costs and expenses) suffered or incurred by us and arising directly or indirectly out of the distribution of Content submitted by you to us.
9.1 You are solely responsible in all respects for all use of and for protecting the confidentiality of any username and password that may be given to you or selected by you for use on our Site. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding our Site that comes (or ought reasonably to have come) to your attention.
10.1 We provide information on this Site free of any access charge, unless expressly stated. Information provided on the Site is provided on the basis of no liability for the information given. Although we hope this Site will be of interest to users, we accept no liability and offer no warranties in relation to it and its content, to the fullest extent such liability can be excluded by law.
10.2 In no event shall we be liable to you for any direct, indirect or consequential loss, loss of profit, revenue or good will arising from your use of the Site or information on the Site. Subject as provided below, all terms implied by law are excluded.
10.3 We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentation that cannot, under English law, be excluded.
11.1 Because laws and regulations differ from country to country, we make no warranties, express or implied that making our Site or any of our services available in any particular jurisdiction outside of the United Kingdom is permitted under any applicable non-UK laws or regulations. Accordingly, if making our Site or any of our services available in your jurisdiction or to you (by reason of nationality, residence or otherwise) is prohibited, our Site or any of our services (as applicable) are not offered to you.
11.2 You accept that if you are resident outside of the United Kingdom, you must satisfy yourself that you are lawfully able to use our Site or purchase our services (as applicable). We accept no liability, to the extent permitted by applicable law, for any costs, losses or damages resulting from or related to the use of our Site or the purchase or attempted purchase of any of our Services by persons in jurisdictions outside the United Kingdom or who are nominees of or trustees for citizens, residents or nationals of other countries.
12.1 We reserve the right to bar users from the Site, on a permanent or temporary basis at our discretion. Any such user shall be notified and must not then attempt to use the Site under any other name or through any other user.
13.1 Coventry Solihull & Warwickshire Sport is an official department of Coventry City Council, operating under a Service Level Agreement.
13.2 In the event of any inconsistency between these terms and conditions, our Privacy Commitment and our Website Terms and Conditions then the terms and conditions shall take first precedence, our Privacy Commitment shall take second precedence and our Website Terms and Conditions shall take third precedence.
13.3 Any formal legal notices should be sent to us at the address at the end of these terms and conditions by email confirmed by post.
13.4 Failure by us to enforce a right does not result in waiver of such right.
13.5 You may not assign or transfer your rights under this agreement.
13.6 You and we agree that English law applies to these terms and conditions and that any dispute between us regarding the Site will only be dealt with by the English courts.
